Frequently asked questions

Is overtime taxed differently to normal pay?

No. Overtime pay is taxed exactly the same way as your normal salary through PAYE — there is no separate overtime tax rate. However, extra overtime income can push some of your earnings into a higher tax band or reduce your Personal Allowance if your total income rises above certain thresholds.

Can you be forced to work overtime in the UK?

It depends on your contract. If your employment contract includes a clause requiring overtime when reasonably requested, you can usually be required to work it. If your contract is silent on overtime, your employer generally cannot force you to work it without your agreement, though refusing reasonable requests repeatedly could affect your employment relationship.

When does regular overtime become contractual?

If you work a consistent pattern of overtime over a long period (commonly cited as around 3 months or more) and your employer has not objected, it can become an implied contractual right or expectation, even if not written into your original contract. This is assessed case by case under UK employment law.

Do you accrue holiday on overtime?

If you work regular, guaranteed overtime, it should normally be included when calculating your holiday pay. Genuinely voluntary, irregular overtime may still count towards holiday pay under recent UK case law if it forms a regular part of your normal remuneration.

Is overtime pensionable?

It depends on your pension scheme rules. Many workplace pension schemes calculate contributions on basic pay only, excluding overtime, but some schemes do include overtime earnings. Check your specific scheme's definition of pensionable pay or ask your employer's HR/payroll team.

Can apprentices work overtime?

Yes, apprentices can work overtime if their contract allows it, subject to working time and, for apprentices under 18, additional working hours restrictions. Overtime pay for apprentices must still meet at least the Apprentice National Minimum Wage for standard hours, with any overtime paid at the rate set out in their contract.
